2. ABOUT OUR PRODUCTS

2.1 Products

UGRAW LLC offers apparel, accessories, and related products, which may include but are not limited to hats, shirts, hoodies, jackets, and other branded goods collectively referred to as “Products.”

Product descriptions, images, prices, availability, sizing, colors, and specifications are provided for informational purposes. We make reasonable efforts to display our Products accurately; however, we do not guarantee that product images, colors, or details will appear exactly as shown on your device.

We reserve the right to change product pricing, availability, specifications, descriptions, or discontinue any Product at any time without notice.

2.2 Orders

By placing an order, you represent that all information provided is accurate, complete, and current. We reserve the right to refuse, cancel, or limit any order for any reason, including suspected fraud, pricing errors, inventory issues, unauthorized resale activity, or violation of these Terms.

Receipt of an order confirmation does not constitute acceptance of your order. We reserve the right to accept or decline your order after receiving it.

2.3 Pricing and Payment

All prices are listed in U.S. dollars unless otherwise stated. Prices do not include taxes, shipping, handling, customs duties, or other fees unless expressly stated.

You agree to pay all charges associated with your order, including applicable taxes and shipping fees. Payment must be successfully processed before an order is fulfilled.

2.4 Shipping

Shipping times are estimates only and are not guaranteed. UGRAW LLC is not responsible for delays caused by carriers, customs, weather, incorrect shipping information, failed delivery attempts, or events outside our reasonable control.

Risk of loss and title for purchased Products pass to you once the Product is delivered to the carrier.

2.5 Returns, Exchanges, and Refunds

Our return, exchange, and refund policy is available at returns.

Unless otherwise stated, Products must be returned in unused, unworn, unwashed, and original condition with tags and packaging intact. We reserve the right to deny returns or exchanges that do not comply with our policy.

2.6 Warranty

In the case of manufacturing defects, UGRAW LLC may replace defective Products within 30 from the original purchase date.

This warranty does not cover damage caused by normal wear and tear, misuse, improper care, accidents, alterations, negligence, fading, shrinkage, improper washing, or other damage not resulting from a manufacturing defect.

If the same Product is no longer available, we may, at our discretion, provide a replacement of comparable value, store credit, or another reasonable remedy.

3. GENERAL TERMS OF USE

3.1 Accurate Information

You represent that you own or have the necessary rights to grant this license.

5.4 Monitoring and Removal

UGRAW LLC has the right, but not the obligation, to monitor, edit, remove, or refuse User Generated Content for any reason, including content we consider inappropriate, unlawful, infringing, misleading, or inconsistent with our brand.

To the fullest extent permitted by law, UGRAW LLC’s total liability for any claim arising out of or relating to these Terms, the website, services, or Products shall not exceed the greater of $100.00 or the amount you paid to UGRAW LLC for the Product giving rise to the claim.

14. ARBITRATION AND CLASS ACTION WAIVER

14.1 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the website, Products, services, or your relationship with UGRAW LLC shall be resolved by binding arbitration, except where prohibited by law.

The arbitration shall be conducted on a confidential basis in California under the rules of the American Arbitration Association or another mutually agreed arbitration provider.

The arbitrator shall have authority to award all remedies available under applicable law, subject to the limitations set forth in these Terms.

14.2 Waiver of Jury Trial

You and UGRAW LLC agree to waive the right to trial by jury for any dispute covered by this arbitration agreement.

14.3 Class Action Waiver

You and UGRAW LLC agree that claims may be brought only in an individual capacity and not as a plaintiff, class member, or representative in any class, collective, consolidated, or representative proceeding.

The arbitrator may not consolidate more than one person’s claims or preside over any form of class or representative proceeding unless both parties expressly agree in writing.

14.4 Exceptions

Nothing in this section prevents either party from seeking relief in small claims court where permitted or seeking injunctive or equitable relief for intellectual property misuse, unauthorized access, or misuse of confidential information.

UGRAW LLC respects the intellectual property rights of others and expects users to do the same.
